About Us These terms and conditions of sale constitute a binding contract between, you the customer and CJ’s Home Decor & Fireplaces, LLC. You the customer accepts these terms and conditions of sale by making a purchase, placing an order by phone, fax, mail, e-mail or Internet.

TERMS AND CONDITIONS OF SALE

CUSTOMER INFORMATION:
Charges for transaction will appear on your credit card or bank statement under the name of CJ's Home Decor & Fireplaces, LLC.

SHIPPING POLICY:
Please inspect your order thoroughly before signing the bill of lading or delivery receipt. CJ's Home Decor & Fireplaces, LLC will not be liable for damages after delivery of products. We recommend you the customer open all the boxes before signing for the products.

DO NOT REFUSE PRODUCT!
Products refused by customer after product has been shipped are subject to a 35% restocking fee and all shipping charges.!

DAMAGED MERCHANDISE RECEIVED

Items Shipped Via UPS Ground / FedEx Ground / DHL Ground
When product is received damaged. you HAVE TO DO THE FOLLOWING STEPS.
1) Fill out damage form online within 24 hours, from web site you ordered, with all the necessary information.
2) Send picture of damage (box, product etc) to info@cjshomedecor.com
3) You will receive instruction by e-mail within 48-72 hours how your claim will be handled.
4) You will also need to retain the merchandise packing material for inspection by the carrier.
5) CJ's Home Decor & Fireplaces will promptly file a claim on your behalf if steps above are followed. We can not file claim until you submit damage form and proveid all the information.
6) No exception!

Items Shipped Via Common Carrier: (Ex:R&L Carriers, USF Holland, FedEx Freight, etc)
Upon receipt, all LTL shipments must be carefully inspected by the customer and any damages or missing items must be noted on the bill of lading. Signing for the shipment without notation of any damages on the bill of lading means that the shipment is being signed for in good terms, and any recourse to gain credit from the freight company will be lost. CJ's Home Decor & Fireplaces is not responsible for LTL shipments once they leave our warehouses.
Claims must immediately be filed with the carrier by consignee/buyer. From the time a carrier picks up a shipment, that carrier assumes all responsibility for that shipment. Claim has to be filed by consignee/customer/buyer - No exception!

Items Which Are Picked Up At CJ's Home Decor & Fireplaces:
Customer must inspect all items they are picking up before removing them from CJ's Home Decor & Firepalces, LLC warehouse. CJ's Home Decor & Fireplaces will not accept damaged items for return if they are picked up from the warehouse.

Note:
Failure to follow these procedures may result in forfeiture of monies due to you. Any damage or loss incurred in transit is the responsibility of the carrier.
All claims have to be supported with pictures broken/damaged part, invoice number and name of purchaser, no claim will be handled/accepted if no documentation is provided. In some instances we need to have the damaged goods sent back to us in order to send you a replacement.

EXCHANGES/RETURNS:
Due to the custom nature of our built-to-order products. ALL SALES ARE FINAL. Exchanges will be at CJ's Home Decor & Fireplaces, LLC discretion.
NOTE: ANY PRODUCTS THAT ARE INSTALLED OR ALTERED BY THE CUSTOMER ARE NOT ELIGIBLE FOR EXCHANGE
Do not return any merchandise for any reason without first e-mailing our customer service department support@cjshomedecor.com. All unauthorized returns will be refused at our dock. Returns over 10 days from date of receiving merchandise will not be accepted.
CJ's Home Decor is not a "try is out service". Once you have purchased an item form one of our web sites a return will be permitted for genuine defects in the purchased item. We are very customer service oriented but have had some abuses of our generosity and efforts in the past.
Customer is responsible for returning the item (shipping prepaid) in the original packaging and in sealable condition. All returns must include original factory box, original factory packaging (foam, plastic, plastic on frame, wrappings, etc) blank, unfilled warranty cards, all instruction booklets and paperwork, along with a copy of your invoice. Do not deface original factory cartons or packaging in any manner. Please properly package and insure the item so a claim can be filed with the carrier if damage occurs during return shipment. Claims can not be filed on items not properly and securely packaged. Goods are to be returned, freight prepaid, ALL RETURNS MUST BE AUTHORIZED BY US AND RMA (Return Merchandise Authorization) MUST BE ISSUED. NO CREDIT WILL BE GIVEN ON MERCHANDISE RETURNED WITHOUT AUTHORIZATION. Any "Shipping Included" (Free Shipping) item will have the outbound freight charge deducted from the total refund. Many items have promotional (reduced) shipping charges - the shipping cost on your order may not reflect the actual shipping cost. The 10 day time frame begins when you receive your order. Returns shipped beyond the 10 day time frame will not be refunded and will be returned to the sender at their expense.
There will be a 35% restocking charge for allowed merchandise returned to CJ's Home Decor & Fireplaces, LLC warehouse. NOTE: Any outbound freight (Shipping Included - Free Shipping) will be deducted before refund.
MISSING PARTS OR HIDDEN DAMAGE:
Upon acceptance of your shipment, you have 24 hours in which to notify CJ’s Home Decor & Fireplaces, LLC @ info@cjshomedecor.com of any missing parts or hidden damage, not notifying CJ’s Home Decor & Fireplaces, LLC/dba www.cjshomedecor.com within this time frame any future claim for said parts will be null and void. After 24 hours any parts that have to be sent out to repair merchandise, will have to be paid by the customer or are shipped COD. We implore you to examine your order in full upon time of delivery and notify us immediately before accepting delivery if you find damaged or missing parts.

NOTE:
If customer misrepresents the delivery address as a business address and it is in fact a home business in a residential area all residential charges made by trucking/delivery company will be the responsibility of the buyer/customer and back charged to your credit card or reflect in your invoice. Any address correction done by FedEx, UPS or any other carrier due to misrepresentation on order form by customer will reflect in a back charge and customer will be sent an invoice.
All Glass Door Shipments Need a Release Signature, in other words someone has to be home to accept delivery. CJ's Home Decor & Fireplaces, LLC will email you a tracking number, at time shipment left our warehouse.

ORDERS:
Our terms are 100% with your Internet order. Credit card will be charged at time of placing order over the internet or by phone. No returns or cancellation are accepted on orders once the order is in production or placed by phone after 24 hours. Where no dispute was made within 24 hours of your order, your acceptance of the terms and conditions is assumed. If order is canceled or changed within the the first 24 hours a 5% handling fee will be accessed. All orders must be paid in full. Payment information and authorization must be included with your order. Orders will not be shipped until payment is received.

OPEN ACCOUNTS:
Any account witout an approved credit application on file with CJ's Home Decor & Fireplaces, LLC, will require PREPAYMENT. Standard terms for credit on approved open accounts are NET 30 Days. Payment is to be made according to each invoice. Late invoices will be charged 1 1/2% per month or 18% per annum. Any collection charges will be in addition to this interest.

PRICES ,PROMOTION & PICTURES:
We make every effort to provide our customers with up-to-date, accurate information. Occasionally things happen that are beyond our control (new product delays, price changes, etc). All given colors and dimensions are the closets approximations available. Although our staff of proof readers work diligently to ensure the accuracy of copy descriptions and prices, we reserve the right to correct typographical errors. Again, if you have any question on the price or availability of an item, please call for assistance. Photographs represent pictures from manufacturers website or literature. The actual flame color, patterns and burn time may vary slightly due to air movement, location of the product, climate, and amount and quality of insulation. All natural materials (i.e. wood products, marbles, stone, etc.) and most finishing materials (i.e. tiles, enamel glazing, paint samples, etc.) include imperfections and may vary from samples and illustrations furnished by manufacturer. CJ’s Home Decor & Fireplaces, LLC is not responsible for any variations in materials or changes by the manufacturer.

CREDIT CARDS:
We accept Visa, MasterCard und Discover. You must enter or provide us with the name as it appears on your credit card billing statement!

SHIPPING/FREIGHT CHARGES:
We currently offer free shipping in the 48 continental us states. We do not ship outside the 48 continental us states.
For Truck Deliveries (Common Carrier, R&L Carriers, Fedex Freight East, Con-Way) READ BELOW!
Products shipped within the five boroughs of New York, Long Island, Martha's Vineyard or to other restricted access areas an additional will apply depending on shipping company. This is due to the transportation surcharge or transport for delivery to these areas.

CREDITS:
Credit will be issued towards credit card you supplied at the time of purchase. Time to issue credit will be 30 days from date of receiving the returned merchandise as per conditions stated in Returns.

CLAIM OF DEFECTIVE ITEMS:
If a claim is made that an item is defective and returned to seller and seller deems item to be free of any and all manufacturer defects. Customer will be charged back on their credit card or invoiced for the cost of shipping to and from the customers home or to a business or terminal at the sellers discretion.

REFUSED MERCHANDISE:
Refused merchandise without receiving an RMA# from a www.cjshomedecor.com / CJ 's Home Decor & Fireplaces Representative, will not be accepted and will be returned to the customer at their expense. For further questions regarding these terms, please email us at support@cjshomedecor.com

WARRANTY:
Refer to manufactures specification - We are not responsible for manufacturer defects. All warranty claims have to be supported with pictures of the problem or broken/damaged part, no claim will be handled/accepted if no documentation is provided.
NOTE: Warranty does not cover shipping cost, only cost of part that has to be replaced.


SATISFACTION:
If you are not completely satisfied with the handling of your order, please write to our customer service department manager at the address below, and we will do our best to satisfy your request. Returns and exchanges must be made within 10 days from the date of receipt of merchandise. Your credit will be issued towards your credit card you supplied. All merchandise returned must be shipped prepaid.

CJ's Home Decor & Fireplaces LLC shall be held harmless from any and all claims by the buyer as a result of injury, damage or wrongful installation to an ultimate user or other person caused by the product sold herein by the seller to the buyer, whether the injury or damage results from the assembly, installation, operation, shipment, storage or manufacture of this product.
Please consult local building codes prior to installing and of the products. Flame appearances, when operated by homeowner, may differ slightly from that pictured on our sites. Installations must be done by qualified service person.
